Stormwater Permitting / Erosion & Sediment Control
State Stormwater Permitting
On July 1, 2007 the State of North Carolina Department of Environmental Quality (NCDEQ) categorized Henderson County as an "urbanizing area" and applied phase II post-construction stormwater requirements to all land in the County, including within the Town of Mills River. The goal of the post-construction stormwater program is to protect surface waters from the impacts of stormwater runoff after developments are constructed.
Development that cumulatively disturbs one acre or more of land, including development that disturbs less than one acre of land that is part of a larger common plan of development or sale, shall comply with phase II post-construction stormwater permitting regulations.
The Town of Mills River relies on NCDEQ to conduct all State stormwater permitting within the Town's jurisdiction in areas that are outside of water supply watersheds. Areas within water supply watersheds are reviewed and permitted locally by the Town. State Erosion & Sediment Control Permitting
The Town of Mills River also relies on NCDEQ Division of Energy, Mineral, and Land Resources (DEMLR) to conduct all erosion and sediment control permitting and enforcement within the Town's jurisdiction. The goal of the State Erosion & Sediment Control (E&SC) Program is to allow development while preventing sediment pollution to surface waters through established standards.
Development that cumulatively disturbs one acre or more of land, including development that disturbs less than one acre of land that is part of a larger common plan of development or sale, shall comply with State erosion and sediment control regulations.
